The counsel for the petitioner has made prayer that the present petition be disposed of having become infructuous as detenue Shamshad Khan has already been arrested in criminal case under NDPS Act. The counsel for the petitioner further contended that the aforesaid case has been falsely foisted on the said detenue. ( 2 ) CRWP-11433-2021 On the other hand, the State counsel submitted that the Shamdshad Khan was arrested by the police in accordance with law on the basis of one FIR registered against him under NDPS Act. In view of the above, as Shamshad Khan has already been arrested by the police, without expressing anything regarding legality of his arrest, the present petition is hereby dismissed having been rendered infructuous.
