RAJ MOHAN SINGH, J. (ORAL) Earlier CRM-M No.39433 of 2019 was filed by the petitioner. When the Court was about to dismiss the same, learned counsel for the petitioner sought to withdraw the same on 04.08.2021 and accordingly, the said petition was ordered to be dismissed as withdrawn.

The Court has taken note of the fact that the affidavit filed by Gobinder Singh, PPS, Deputy Superintendent of Police, Sub Division, Bhawanigarh District Sangrur showed that the FSL report dated 02.09.2019 was received in the Court in due course. Petitioner was granted interim bail till 16.12.2019 vide order dated 21.10.2019 passed by this Court. Even after receipt of FSL report, the petitioner did not surrender and continued to be on interim bail till passing of order dated 04.08.2021. The factum of receipt of FSL report was sought to be ignored with impunity. Even the State did not file exact status report despite ANITA DEVI 2022.04.20 17:18 I attest to the accuracy and integrity of this document

CRM-M No. 52844 of 2021(O&M) -2the order dated 16.12.2019, vide which State was directed to file the FSL report on the next date of hearing i.e. 10.01.2020. On 10.01.2020, learned State counsel further sought time to file an affidavit with regard to report received from the FSL as well as involvement of the petitioner in any other case. After noticing the incriminating facts, this Court did not agree with the contention of learned counsel for the petitioner in CRM-M No.39433 of 2019 and faced with this situation, learned counsel for the petitioner got the petition dismissed as withdrawn vide order dated 04.08.2021.

After surrendering before the authorities, the petitioner has again approached this Court for grant of regular bail. Petitioner has already misused the concession of interim bail, therefore, no indulgence can be granted. Dismissed.
