The present petition has been filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 seeking direction to official respondents to  Stop multiple enquiries at the instance of respondent No.5 in the present case, as in earlier inquiry had already been conducted and version of respondent No.5 is found to be false by the Inquiry Officer.

Learned counsel for the petitioners contends that the petitioners are aggrieved by the notices being sent to them in multiple enquiries which are being conducted by the police. It is further stated that respondent No.5-complainant had entered into an agreement to sell the land measuring 8 kanals 11 1⁄2 marlas with the petitioners wherein they have partly executed the sale deed. He further states that the matter is civil in nature, however, in order to pressurize the petitioners to return the earnest money, multiple complaints have been filed. Moreover, in a detailed enquiry conducted by respondent No.3, it is held that the matter between the parties is related to a dispute over property and is civil in nature. Since the petitioners are being summoned on similar complaints which are being filed multiple times, the present petition is disposed of with a direction that the petitioners in case, are required to join the investigation, reasoned 07 days prior notice(s) be given to them in accordance with the provisions of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023.
