   #   FIR No. 51 dated 05.04.2025 under Sections 318(4), 61(2) of BNS and Section 24 of the Immigration Act registered at Police Station Koom Kalan District Ludhiana  $ %& % ' (       )* +This petition has been filed under Section 482 of BNSS, for the grant of anticipatory bail in case FIR No. 51 dated 05.04.2025 under Sections 318(4), 61(2) of BNS and Section 24 of the Immigration Act registered at Police Station Koom Kalan District Ludhiana.

The case of the prosecution is that one Sunny Mehta along with the petitioner cheated upon the complainant under false pretext of sending him to Australia for a sum of Rs. 24 lac, out of which Rs. 3 lac was deposited into the account of the present petitioner, who is employed by Sunny Mehta. This amount was subsequently transferred to Sunny Mehta's account.

Learned counsel for the petitioner submits that the petitioner acted solely on the instructions of Sunny Mehta, her employer, and has no role in the false promise made by the coaccused, Sunny Mehta to the complainant regarding sending him abroad.

CRM-M-39137-2025 (O&M) -2and when required and in the event of her arrest, she shall be released on interim bail on her furnishing bail bonds to the satisfaction of SHO/Investigating Officer, subject to the following conditions as envisaged under Section 482(2) of the BNSS [erstwhile Section 438(2) Cr.P.C.]:- i) that the petitioner shall make herself available for interrogation by a police officer as and when required; ii) that the petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court or to any police officer; iii) that the petitioner shall not leave India without the prior permission of the Court;

iv) such other condition as may be imposed under sub-section

(3) of Section 480, as if the bail were granted under that section."
