Mr. Ajay Ghangas, Advocate for respondents no. 1 and 2. *** After arguing for some time, learned counsel for the appellant submitted that he be allowed to withdraw the present appeal granting him liberty to approach the revenue authorities seeking partition in accordance with law. He further submits that it be clarified that the judgments and decrees passed by the Courts below shall not prejudice the rights during the partition proceedings.

Learned counsel for respondents no. 1 and 2 states that the Court may pass any order in accordance with law with regard to the prayer made by learned counsel for the appellant.

Heard.

The dispute is between co-sharers in the joint land. It would be proper and appropriate if they go in for partition. Therefore, the prayer made by learned counsel for the appellant is accepted.
