By this common order, both the aforementioned petitions, i.e. CRM-M-39394-2025 and CRM-M-56958-2025 shall stand disposed of.

Present petitions have been filed by the petitioners, seeking grant of regular bail, in case, FIR No.128, dated 19.08.2024, under Sections 105 and 3(5) of BNS (Sections 304 and 34 of IPC), registered at Police Station Nihal Singh Wala, District Moga.

On the very outset, learned State counsel has filed status report dated 10.03.2026 in the Court today and the same is taken on record. Registry is directed to tag the same at an appropriate place on the file.

Case put forth by the prosecution in the status report dated 10.03.2026, as mentioned in paragraph Nos.5 to 8, is reproduced hereunder:- "5.
That FIR No. 128 dated 19.08.2024 under Section 105 and 3(5) BNS was registered at Police Station Nihal Singh Wala, Moga on the complaint of Gurdit Singh against 1) Arshpreet Singh @ Arshu 2) Resham Singh (son of aunt/massi of Arshu) and 3) one unknown person.
That during the investigation the unknown person was found to be 3)Jaspreet Singh @ Gattu as per the supplementary statement dated 10.01.2025 of the complainant. Thus, Jaspreet Singh @ Gattu was nominated as an accused in the present FIR No. 128 (Supra) vide DDR No. 33 dated 10.01.2025.

That the brief facts of the present case are that the complainant got recorded his statement, wherein he stated that his brother Amninder Singh and others had a fight with one Arshu about 2 months ago. Due to the grudges, they were looking for a chance to beat his brother. On that day i.e. 19.08.2024 at about 03:40 PM he was coming towards Nihal Singh Wala road by foot while he saw his brother namely Amninder Singh was coming on his motorcycle make Platina from the side of the village Nihal Singh Wala and his friend namely Kiranpreet Singh was coming behind him on another motorcycle, whereas his brother Amninder Singh (now deceased) raised a loud voice upon seeing the complainant that Arshu and others individuals are following them and they will kill him.
In the meantime, they gave kick blow to the motorcycle of his brother Amninder Singh, due to which motorcycle of Amninder Singh was struck into the tree and Amninder Singh suffered number of injuries. Thereafter, the brother of the complainant was taken to the Civil Hospital, Nihal Singh Wala, where the brother of the complainant died.

That during the course of investigation various/sincere efforts were made to arrest the accused namely Arshpreet Singh @ Arshu. Thereafter, the co-accused namely Resham Singh was arrested on 29.08.2024 and the accused namely Arshpreet Singh @Arshu was arrested on 16.05.2025, in accordance with law.

That as per the record, the supplementary statement of the complainant was recorded on 10.01.2025, wherein he specifically stated that on 19.08.2024 the co-accused namely Jaspreet Singh @Gattu, had kicked the motorcycle of his brother, namely Amninder Singh (now deceased).
It is pertinent to mention here that as already stated above, the said supplementary statement could not be recorded without the permission of the court, therefore, the concerned Investigating officer has been suspended and departmental proceeding has been initiated against him as well as the then Station House Officer, Police Station Nihal Singh Wala, Moga.
Thus, on the basis of the said supplementary statement of the complainant, the accused namely Jaspreet Singh @ Gattu was nominated as an accused in FIR No. 128 (supra), vide DDR No. 33 dated 10.01.2025, as already stated above. He was subsequently arrested by the investigating agency on 11.01.2025."

Thus, from the investigation, it has been culled out that petitioner - Arshpreet Singh @ Arshu (in CRM-M-56958-2025), along with petitioner - Jaspreet Singh @ Gattu (in CRM-M-39394-2025), was present on the spot at the time of the occurrence, and petitioner-Arshpreet Singh @ Arshu was allegedly having old grudges with Amninder Singh (deceased).
Allegation regarding giving a kick to the motorcycle of Amninder Singh surfaced after a period of about four months, i.e. on 10.01.2025, when supplementary statement of the complainant was recorded, and petitioner-Jaspreet Singh @ Gattu was implicated as an
accused in the present case, alleging that he had given the kick to the motorcycle.

Learned State counsel has also filed the custody certificates of both the petitioners in Court today, and the same are taken on record. The office is directed to tag the same at the appropriate place. A copy thereof has been supplied to learned counsel for the petitioners. 6.
As per the custody certificates, petitioner-Arshpreet Singh @ Arshu has undergone custody for a period of 07 months and 06 days, whereas petitioner-Jaspreet Singh @ Gattu has undergone custody for a period of 08 months and 03 days in the present case. 7.
Both the petitioners, namely Jaspreet Singh alias Gattu and Arshpreet Singh alias Arshu had earlier been granted the concession of interim bail by this Court, vide orders dated 11.09.2025 (passed in CRMM-39394-2025) and 22.12.2025 (passed in CRM-M-56958-2025). 8.
Considering the nature of allegations and conduct of the Investigating Officer in introducing a changed version after a period of four months, by way of recording a supplementary statement of the complainant implicating petitioner-Jaspreet Singh @ Gattu, this Court deems it appropriate to grant the concession of regular bail to him in the present case.
Consequently, prayer made in the present petition, i.e. CRMM-39394-2025 is allowed. Petitioner - Jaspreet Singh alias Gattu is ordered to be released on bail, subject to his furnishing bail/surety bonds to the satisfaction of the learned trial Court/ Chief Judicial Magistrate/
Illaqa Magistrate/ Duty Magistrate concerned, if not required in any other case.

Needless to observe that petitioner - Jaspreet Singh alias Gattu shall not extend any threat and shall not influence any prosecution witness in any manner directly or indirectly. 10.
Any of the discussion done and recorded here above, shall not be construed as an expression of opinion on the facts of the case. Therefore, trial Court is expected to decide the case by taking an independent view, on the basis of evidence available on record, as expeditiously as possible, in accordance with law. 11.
It is further made clear that if, in future, petitioner - Jaspreet Singh alias Gattu is directly found indulged in similar kind of activities, this order shall be deemed to be cancelled.

As far as petitioner-Arshpreet Singh @ Arshu is concerned, it has been alleged that he was harbouring a grudge against the deceased and, as per the investigation, he was present at the spot. It is further alleged that at the initial stage, he was the one who had given the kick blow to the motorcycle of the deceased. Moreover, he has undergone custody for a period of only about 07 months. In these circumstances, this Court does not deem it appropriate to consider the prayer for grant of regular bail to him, at this stage. 13.
Accordingly, petition, i.e. CRM-M-56958-2025, stands dismissed.

Since, vide order dated 22.12.2025, petitioner-Arshpreet Singh @ Arshu was granted the concession of interim bail by this Court,
the said concession is hereby vacated, and he is directed to surrender before the jail authorities, within a period of three days from today. Investigating Officer is also directed to take all necessary steps to ensure his re-arrest in accordance with law. 15.
With the directions issued here above, both the present petitions stand disposed of.
