(ORAL) The petitioners are seeking anticipatory bail in FIR No.111 dated 25.05.2017, under Sections 279, 336 of the Indian Penal Code, 1860, and Section 11 of the Prevention of Cruelty to Animals Act, 1960, besides Sections 177, 181 and 196 of the Motor Vehicles Act, 1988, registered at Police Station Ambala Sadar, District Ambala. Learned counsel for the petitioners contends that the petitioners had earlier been granted bail by the trial Court and they had been regularly attending the Court proceedings. He also contends that petitioner No. 1 is 68 years old truck driver and he had gone to Ladakh while transporting goods and due to snowfall the roads were closed and, therefore, he could not appear before the Court. He also contends that petitioner No. 2 is also a truck driver. He was in Saharanpur and he was not informed about the date of hearing by his counsel and, therefore, he could not appear before the SATYAWAN 2019.11.20 18:20 I attest to the accuracy and integrity of this document

CRM-M-40302-2019 (O&M) Court. Consequently, their bail was cancelled. This Court, by the order dated 20.09.2019, had directed that in case the petitioners appear before the trial Court then they were to be released on interim bail on their furnishing bonds to the satisfaction of the trial Court.

Learned counsel for the petitioners contends that petitioner No.1-Jaswant Singh has appeared before the trial Court on 04.10.2019 while petitioner No.2-Mohammad Usman appeared before the trial Court on 05.10.2019, in terms of the previous order of this Court dated 20.09.2019 and have been granted interim bail.

In view of the submissions of learned counsel for the petitioners and the petitioners having appeared before the trial Court, the order dated 20.09.2019 granting interim bail to the petitioners is made absolute.

However, the petitioners shall henceforth appear before the Court on each and every date of hearing and would not absent themselves except with the prior permission of the Court. The petition stands disposed of.
