By filing the present appeal, the landowners are seeking enhancement of compensation for the acquired land. Briefly, the facts of the case are that State of Haryana vide notifications dated 16.8.2002 and 3.10.2002 issued under Section 4 of the Land Acquisition Act 1894 (for short, 'the Act'), sought to acquire 26.06 acres of land situated in village Kakroi, Hadbast No. 192, Tehsil and District Sonepat for construction of Career Lined Channel. It was followed by notification dated 14.11.2002, issued under Section 6 of the Act. The Land Acquisition Collector (for short, 'the Collector'), vide award No.9 dated 18.9.2004, assessed the market value of the acquired land @ ` 2,00,000/- per acre. Dissatisfied with the award of the Collector, the landowners filed objections. On reference under Section 18 of the Act, the learned court below assessed the market value of the acquired land @ ` 4,00,000/- per acre. The aforesaid award has been impugned by the landowners in the present appeal.

Learned counsel for the landowners submitted that the claim made in the present appeal is squarely covered by judgment of this Court in RFA No. 2815 of 2008 - Prem and others v. The State of Haryana and SHARMILA 2016.01.05 11:24 I attest to the accuracy and authenticity of this document.

RFA No. 2247 of 2014 (2) others, decided on 27.4.2009, whereby compensation for the acquired land pertaining to village Kakroi was further enhanced. Learned counsel for the State did not dispute the aforesaid fact.
