The petitioner herein is a judgment debtor. His objection petition has been dismissed by the Executing Court. There is an order of the competent Court dated 10.10.2017.

The Wakf Tribunal has, vide judgment dated 10.10.2017, directed the petitioner to deliver the possession. Now, the petitioner wishes to object to the delivery of possession on the ground that the property belongs to the Custodian Department and it is not a Wakf property. This defence could be taken by the petitioner before the Wakf Tribunal. Now, at this stage, the petitioner cannot object to the maintainability of the execution petition.

With the observations made above, the present revision petition is disposed of.
