NIDHI GUPTA, J. (ORAL) Prayer in this 2nd petition filed under Section 439 Cr.P.C. is for grant of regular bail to the petitioner in case FIR No. 53 dated 12.08.2020 registered under Sections 363, 376 and 506 IPC and Section 4 of the Protection of Children from Sexual Offences Act, 2012 at Women Police Station, Palwal, District Palwal. Learned counsel for the State has filed custody certificate dated 15.02.2024, which is taken on record, as per which the petitioner has been in custody as an undertrial for a period of 03 years, 06 months and 04 days.

After arguing for some time, when this Court is not inclined to grant bail to the petitioner, learned counsel for the petitioner submits that he may be permitted to withdraw the present petition, at this stage. Permitted to do so.

Dismissed as withdrawn, at this stage.
