1. By way of present writ petition, petitioner has approached this Court interalia for directing the respondents to pay compensation of Rs.50 lacs on account of death of petitioner's husband, Ashwani Kumar, due to electrocution.
2. Counsel for the petitioner states that on 08.11.2021, petitioner's husband went to check an electricity pole after there was a spark in a transformer. He collided with an electricity pole and was electrocuted. He was shifted to a hospital, but he was declared as brought dead. Counsel has referred to the Death Certificate, Annexure P-1, postmortem report, Annexure P-2, as well as DDR, Annexure P-3, registered regarding the incident. Counsel asserts that electricity poles are being managed by the Dakshin Haryana Bijli Vitran Nigam Limited (DHBVNL), who have framed a policy dated 15.07.2019, Annexure P-7, which provides for grant of compensation in cases of fatal/nonKAMAL SHARMA 2025.08.02 14:05 I attest to the accuracy and authenticity of this order/judgment.

CWP-21385-2025 -2fatal accidents due to electrocution. Counsel has relied upon a judgment passed by a Co-ordinate Bench of this Court in CWP-29058-2023 titled as "Bharat Ahirwar Versus Dakshin Haryana Bijli Vitran Nigam Limited and others", decided on 05.12.2024, Annexure P-8, to contend that in terms of Clause 11 of the policy, which provides for "no fault liability", petitioner has to be compensated. It is his case that despite repeated representations, respondents have not granted any compensation. He requests that a direction be issued to the respondents to examine representation dated 20.10.2024, Annexure P-6.
3. Having heard counsel for the petitioner and considering to limited prayer made by him, this Court does not intend to call upon the respondents.
4. A perusal of the petition shows that the representations submitted by the petitioner are pending with the authorities and are not being attended to. According, a command is issued to respondent No.2, Chief Engineer, Operation Division, DHBVNL to examine representation, Annexure P-6, and pass appropriate order thereon within a period of four months from the date of communication of a copy of this order. While passing order, he will keep in mind the policy, Annexure P-7, as well as the directions passed by this Court on 05.12.2024, Annexure P-8.
5. Writ petition is disposed of.
