(ORAL) Vide this petition, the petitioner seeks the concession of 'regular bail' under the provisions of Section 439 of the Cr.P.C., upon FIR no.208, dated 17.07.2021, having been registered at Police Station Civil Lines, Jind, alleging therein the commission of offences punishable under Sections 272, 273, 420, 467, 468, 472, 473, 475, 476, 468 of the IPC, as also Sections 51 and 63 of the Copy Rights Act, 1957.

Learned counsel for the petitioner submits that the petitioner having been in custody for about 6 months, with the report under Section 173 of the Cr.P.C. already having been submitted to the competent court, he may be admitted to bail.

CRM-M-51168 of 2021 -2As regards the factual aspect, learned State counsel does not deny that, but submits that the petitioner having been accused of having manufactured/sold spurious ghee, he does not deserve to be admitted to bail. Having considered the matter, w         the petition is allowed and the petitioner is ordered to be released on bail, subject to his furnishing adequate bail bonds and surety bonds to the satisfaction of the trial court/Duty Magistrate concerned.

Learned counsel for the petitioner submits that in the head-note and in the prayer clause of the petition, an offence punishable under Section 468 of the IPC has been erroneously typed twice, whereas actually the offence alleged to have been committed is under the provisions of Section 486 of the IPC. Consequently the petitioner would be admitted to bail in the context of that offence (Section 486 of the IPC), as also the other offences as he is sought to be charged with.
