As the prosecution evidence is being recorded, the present petition is disposed of with the liberty to the petitioner to raise all the grounds raised in the present petition before the Trial Court at the appropriate stage. Needless to say, the petitioner shall be at liberty to raise all the defences available to him, including, but not limited to the fact that the wife of the deceased has already been paid approximately Rs.35 lacs in proceedings under the MACT.
