***** KARAMJIT SINGH , J. (Oral) Case has been heard through video conferencing on account of COVID-19 Pandemic.

Prayer is for grant of anticipatory bail in case having FIR No.181 dated 8.11.2021 registered under Section 21(1) Mines & Minerals (D&R) Act, 1957 at Police Station Sadar, District Hoshiarpur. Counsel for the petitioner submitted that the petitioner has joined the investigation with the police in compliance of order dated 7.12.2021 passed by this Court.

( 2 ) CRM-M-51066-2021 The State counsel on instruction from ASI Sukhram Singh admitted this fact and further stated that the petitioner is not required by the police for any custodial interrogation.

Admittedly the recovery has already been effected in this case. In view of the above, no purpose will be served even if at this stage the petitioner is subjected to custodial interrogation. Accordingly, the present petition is allowed and order of interim bail dated 7.12.2021 is made absolute. The petitioner is to abide by the conditions as envisaged under Section 438(2) Cr.P.C.
