Due to COVID-19 situation, the Court is convened through video conference.

These petitions under Section 438 Cr.P.C. are filed seeking pre-arrest bail in FIR No. 11 dated 14.1.20214, under Sections 409, 420, 120-B read with Section 34 IPC (Section 201 IPC was added later on) and Section 13(1)(d) of the Prevention of Corruption Act, 1988 registered at Police Station Murthal.

CRM-M-51486-2021 & CRM-M-51489-2021 (O&M) -2passed by this Court on 21.10.2021 in CRM-M-44088 of 2021 stating that similarly situated co-accused were granted interim anticipatory bail in the present FIR and the petitioners had already joined investigation and no recovery is to be made.

Learned counsel for the State appearing on advance notice on instructions submits that the petitioners have joined the investigation and their custodial interrogation is not required. In view of the statement made, the present petitions are disposed of. The petitioners are granted anticipatory bail subject to their joining investigation as and when called for. In the event of their arrest, the petitioners shall be released on bail subject to furnishing adequate bail bonds to the satisfaction of the Arresting Officer. They shall abide by the conditions as envisaged under Section 438(2) Cr.P.C. In case of failure of petitioners to join the investigation, the State would be at liberty to file an application for re-calling of this order.

Photocopy of this order be placed on the file of connected case.
