ARVIND SINGH SANGWAN J. (Oral) Prayer in this petition is for transfer of the Civil Suit No.CS/829/2021, titled as "Surinder Kumar Singal vs Raj Kumar Singal and others", pending in the Court of Additional Civil Judge (Sr. Division), Panchkula to the competent Court of jurisdiction at Panipat. Counsel for the petitioner has relied upon the order dated 19.07.2022 passed in TA No.425 of 2021 and other connected cases and the order dated 08.08.2022 passed in TA Nos.848 and 853 of 2022, vide which some other litigations pending between the same parties, have already been transferred with the consent of the parties. Counsel for the petitioner has argued that in the earlier litigation, the respondent No.

1 Raj Kumar Singal has filed the transfer application in which, with a consent order, all the cases were transferred from Chandigarh to Panipat. It is further submitted that in this case, apart from Raj Kumar Singal, his wife Kiran Singal and another brother Suresh Kumar Singal, who were also a party in the previous transfer petition, are impleaded as defendants No.1, 2 and 5 whereas defendants MOHD YAKUB 2022.10.12 16:10 I attest to the accuracy and authenticity of this document Punjab & Haryana High Court, Chandigarh.

TA No.1212 of 2022 (O&M) No.3 and 4, are the official respondents, who can defend the case at Panipat.

In view of the above, the present petition is allowed and with a direction that the Civil Suit No.CS/829/2021, titled as "Surinder Kumar Singal vs Raj Kumar Singal and others", pending before the Court of Additional Civil Judge (Sr. Division), Panchkula will be transferred to the competent Court of jurisdiction at Panipat, along with all the records.

The District Judge, Panipat will assign the Civil Suit No.CS/829/2021, titled as "Surinder Kumar Singal vs Raj Kumar Singal and others", to the competent Court of jurisdiction. The parties are directed to appear before the trial Court, Panipat, within a period of 01 month from today. The Court concerned, where the litigation pending between the parties, will accommodate them with one date in one calendar month.
