Learned counsel for the petitioners states that he is only aggrieved by the finding, which has been returned by the Trial Court in the order dated 29.10.2022 while disposing off the application under Order 39 Rules 1 and 2 of the Code of Civil Procedure, 1908, wherein it has been observed " since the sale deeds are admitted by the defendants and there is no question of forgery or fraud, the question of execution of the sale deeds to defeat her rights is to be seen after leading the evidence" . Learned counsel further states that this is a finding on merit and would come in his way as he has challenged the sale deeds by way of a civil suit (Annexure P-9). 2.

In the present case, the argument of the learned counsel for the petitioners that the above said finding would come in his way is wholly misplaced in view of the fact that in the last line of the order dated 29.10.2022 it was clarified that any observations made in the order would have no bearing on the merits of the case. CR-5690-2023 (O&M) entertain the present revision petition. However, it is reiterated that any observations made in the said order would not be considered as an expression of opinion on the merits of the case.
