The present revision petition has been filed under Article 227 of the Constitution of India for setting aside the order dated 28.05.2025 passed by the learned Appellate Authority, Ludhiana assessing the mesne profits @ ₹10,000 per month.

Vide the impugned order dated 28.05.2025, the Appellate Authority, Ludhiana had assessed the mesne profits @ ₹10,000 per month for the use and occupation of the shop. The eviction order dated 02.02.2019 passed by the learned Rent Controller was stayed subject to the payment of mesne profits. The present revision petition was filed on 22.07.2025. On 25.07.2025 a request for an adjournment was made by the learned counsel appearing on behalf of the petitioner. The matter was adjourned to 05.12.2025 and it was made clear that pendency of the present revision petition shall not be an impediment in the continuation of the proceedings before the Court AMAN JAIN 2025.09.30 09:15 I attest to the accuracy and integrity of this order/judgment

CR-4735-2025 (O&M) -2concerned. Thereafter, an application for preponement was filed which was allowed on 02.08.2025 and the matter was listed for today. 3.

As per the E-Courts website, it transpires that the petitioner herein had also moved an application under Section 148 Civil Procedure Code, 1908 for enlarging the time granted vide order dated 28.05.2025. Notice in the said application was issued. Meanwhile, since the mesne profits were not deposited, admittedly, the possession was taken by the landlord in the execution proceedings.
