For the reasons mentioned in the application, supported by an affidavit of the appellant, the same is allowed and the delay of 76 days in filing the appeal is hereby condoned.
FAO-4607-2025 (O&M) Seeking enhancement, it is contended by learned counsel that though compensation on account of loss of funeral expenses has been awarded apart from the compensation on account of loss of dependency, but nothing has been awarded under the head of 'loss of consortium' and 'loss of estate'.
Notice of motion only to respondent No.2-Insurance Company only on the aforesaid points.
Mr.Paul S. Saini, Advocate, accepts notice on behalf of respondent No.2-Insurance Company and submitted that he has no objection, in case the present appeal is accepted by granting the compensation of 40,000/- under the head of 'loss of consortium' and an VIVEK PAHWA 2025.12.03 14:02 I attest to the accuracy and integrity of this document Chandigarh
FAO-4607-2025 2025:PHHC:167708 amount of 15,000/- under the head of 'loss of estate', as the enhancement claimed by the claimant is only under the 'conventional head'. In view of the aforesaid statement, the present appeal is hereby disposed of by directing that over and above the amount of compensation of 5,31,600/-, awarded by the Tribunal, the appellant is also entitled to enhanced compensation of 55,000/-, which shall be payable along with interest @ 7% per annum, from the date of filing of claim application till its realization.
