The petitioner through instant petition under Article 226 of Constitution of India is seeking direction to respondents to allot paddy as per milling policy for the year 2023-2024.

The petitioner is engaged in the business of milling rice. The petitioner is dependent upon paddy supplied by the State Government Agencies. The State Government every year frames milling policy known as Kharif Marketing Season Policy (KMS). Like other years the respondent has framed KMS Policy for 2023-2024. The grievance of the petitioner is that respondent is not allotting paddy to the petitioner as per his entitlement. 3.

Learned counsel for the petitioner submits that on the earlier occasion for the same relief, the petitioner preferred CWP-13260-2020 before this Court which came to be disposed of vide order dated 01.09.2020. CWP-19924 of 2023 2023:PHHC:118264 Court directed the petitioner to appear before the respondent. The respondent was directed to decide representation of the petitioner by way of speaking order. The petitioner has filed representation dated 25.08.2023 (Annexure P13) before the respondents who are not paying heed to the aforesaid representation.
