(ORAL) Through this petition under Section 482 Cr.P.C. prayer has been made for quashing order dated 22.09.2022 (Annexure P-12) passed by Additional Sessions Judge, Rewari, in case "SC-437/2021 - State of Haryana v. Ravi @ Sunnu" in FIR No.0101 dated 22.05.2021 registered under Section 302 and 34 IPC and Section 25 of the Arms Act at Police Station Sector 6, Dharuhera, Rewari, whereby application of the petitioner seeking exemption from appearance has been dismissed and his bail bonds and surety bonds have been cancelled and forfeited to the State and he has been summoned through warrants of arrest. Heard.

In the aforesaid FIR, petitioner was arrested on 23.05.2021 and was granted regular bail by this Court vide order dated 06.10.2021. On 22.09.2022 petitioner did not appear before the trial Court and moved RAVINDER SINGH 2022.10.19 11:04 I attest to the accuracy and authenticity of this order/judgment

-2CRM-M-48079 of 2022 application for exemption from his personal appearance on medical grounds. The said application has rightly been dismissed by the trial Court as the petitioner had obtained medical certificate from a private doctor. Moreover, petitioner was not suffering from illness due to which he could not attend the Court. Thus, it is clear that he adopted this tactics just to delay the trial. Therefore, the impugned order is perfectly valid in the eyes of law as no cogent reason has been given by the petitioner for his absence.

In view of the above, this petition is dismissed. However, if the petitioner surrenders before the trial Court within ten days from today and files an application for regular bail, the trial Court will decide the same expeditiously in accordance with law.
