None has made appearance on behalf of the respondent. Even, reply has not been filed. On the last date of hearing also, none had made appearance on behalf of the respondent. As such, the respondent is proceeded against ex parte.

The applicant-wife has filed the present application for seeking transfer of the petition under Section 13 of the Hindu Marriage Act, filed by respondent-husband bearing No.HMA-371-2024, titled 'Amandeep Singh vs. Kamaljit Kaur @ Komal', which is pending in the Family Court, Hoshiarpur and she seeks transfer of the same to the Court of competent jurisdiction at Patiala.

TA-1042-2024 -2born from the said wedlock, who is about 2 years old, is in care and custody of the applicant. The applicant is not having any source of earning and is dependent upon her parental family. She had filed the petition under Section 125 Cr.P.C. as well as complaint under Section 12 of the Protection of Women from Domestic Violence Act, which are pending in the Courts at Patiala and respondent is pursuing both the aforesaid cases.
Keeping in view the aforesaid mitigating circumstances and also taking into consideration the fact of respondent, having not come forward to resist the transfer application, more particularly, when the minor child born from the wedlock, is in the care and custody of the applicant, who is also not having any source of earning, the transfer application is hereby allowed and the petition under Section 13 of the Hindu Marriage Act, filed by respondent-husband bearing No.HMA-371-2024, titled 'Amandeep Singh vs. Kamaljit Kaur @ Komal', stands transferred from the Family Court, Hoshiarpur, to the Court of competent jurisdiction at Patiala. The requisite record of the aforesaid case be sent by the Family Court, Hoshiarpur, to the District and Sessions Judge, Patiala.
Learned District and Sessions Judge, Patiala, shall assign the said petition to the Family Court, Patiala. Even, the parties are directed to appear before the Family Court, Patiala, within a period of one month from today onwards.
