(Oral) Learned counsel for the parties are ad idem that the matter since stands resolved and as per the settlement arrived at between the parties before the Mediation and Conciliation Centre, the present appeal is to be withdrawn by the appellant.

However, learned counsel for the appellant states that vide order dated 20.11.2015 the appellant was to deposit 50% of the amount decreed within a period four weeks' from date of passing of the order, which was duly deposited. Learned counsel would state that the amount due to the respondent has since been paid and the hence said draft be ordered to be released to the appellant.

Learned counsel for the respondent states that in view of the compromise, all amounts due to the respondent stand paid and he has no TRIPTI SAINI 2022.06.01 12:09 I attest to the accuracy and authenticity of this order/judgement

RSA-968-2012 (O&M) -2objection in case the draft of Rs.58,234/- drawn on HDFC Bank deposited with the Executing Court is released to the appellant. In view of the statements made by the learned counsel for the parties, the present appeal is dismissed as withdrawn. However, the appellant would be at liberty to get the draft of Rs.58,234/- deposited with the Executing Court released in it's favour.
