(ORAL) Learned counsel for the petitioner submits that after the withdrawal of the previous petition on 24.05.2023, only one prosecution witness out of the 13 cited has been examined. He submits that the case is being adjourned repeatedly, however, the remaining prosecution witnesses are not putting in appearance to get their statements recorded. Learned State counsel, on instructions from ASI Bhola Singh, has however, disputed the submissions made by the counsel opposite. He, on instructions, has submitted that four prosecution witnesses have already been examined and four witnesses have been given up and the next date before the trial Court is 17.10.2023. In the circumstances, in view of the instructions received by learned State counsel, counsel for the petitioner does not press the instant petition and seeks permissions to withdraw the same. Dismissed as withdrawn.
