This is an application for transferring the civil suit titled as "Jasvir Singh vs. Ramandeep Kaur" bearing No.CS-451 of 2017 instituted on 22.11.2017 for permanent injunction inter alia restraining the defendant-respondent from taking forcible custody of the minor child, Jiwanjot Singh alias Garry, pending in the Court of Civil Judge (Senior Division), Amloh to the competent Court of jurisdiction at Ludhiana. Learned counsel for the petitioner would contend that the petitioner has no means of income and she has to travel a distance of about 58 kilometres (one way) in order to attend the proceedings at Amloh. It has further been contended that evidence is now going on and the petitioner has to go there on each and every date. Heard.

TA-1215 of 2021 -2In the present case, the undisputed fact is that the child is residing at Amloh with the father. The civil suit sought to be transferred was instituted by the respondent in the year 2017. The petitioner has been attending the proceedings till now and now when the case is at evidence stage a transfer of the case is sought.

In view of the above, I find no cogent ground to allow the transfer petition.

Dismissed.
