(ORAL) The petitioner is seeking the concession of anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) in case FIR No.0093 dated 20.07.2024 under Sections 406, 420 and 120-B of the Indian Penal Code, 1860, registered at Police Station Meharban, District Police Commissionerate, Ludhiana. 2.
On 02.09.2024, while noticing the following submissions made by the learned counsel for the petitioner, this Court had directed that no coercive steps shall be taken against the petitioner:- "Learned counsel for the petitioner, inter alia, contends that it is a matter of record that there is a history of strained relations between the petitioner and her brother-in-law Gurnam Singh (prime accused) who allegedly entered into an agreement to sell with the complainant; co-accused Gurnam Singh, in order to settle the disputes pending with the petitioner, entered POONAM RATHORE 2024.12.03 16:26 I attest to the accuracy and authenticity of this document High Court Chandigarh
CRM-M No.42939 of 2024 -2into a settlement and as per the terms and conditions, exchanged the land qua which agreement to sell had been entered into with the complainant. The petitioner unknowingly accepted the terms and conditions and the land which was given to her in exchange by co-accused Gurnam Singh."

Thereafter, vide order dated 01.10.2024, this Court had granted the concession of interim bail to the petitioner and asked her to join investigation.

Learned counsel for the petitioner submits that in compliance of order dated 01.10.2024, the petitioner has joined investigation and cooperated with the investigating agency.

Learned State counsel, on instructions from ASI Rajiv Kumar, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioner is not required for further investigation much less for her custodial interrogation.

In view of the above, the petition is allowed and interim order dated 01.10.2024, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) of BNSS, 2023.
