ARVIND SINGH SANGWAN, J. (Oral) Prayer in this petition is for grant of regular bail to the petitioner under Section 439 of the Code of Criminal Procedure (in short 'Cr.P.C.') in FIR No.180 dated 15.10.2018 registered under Sections 395, 397, 302, 120-B of the Indian Penal Code (in short 'IPC') and 25/27 of the Arms Act at Police Station City Sri Muktsar Sahib, District Sri Muktsar Sahib.

Counsel for the petitioner has submitted that the petitioner is an agriculturist and was not named in the FIR and his name has been surfaced in the disclosure statement of one co-accused Simranjit Singh Simra that 06 accused persons have conspired at the tubewell of the petitioner, who is a relative of one of the co-accused Dilbagh Singh. It is further submitted that the petitioner is not involved in any other case and the challan already stands presented and it will take some time in conclusion of the trial.

CRM-M No.40372 of 2019 Counsel for the State, on instructions from SI Pritam Singh, has not disputed the factual position but opposed the prayer for bail.

Without commenting anything on merits of the case, considering the fact that the petitioner is not involved in any other case; challan stands presented and it will take some time in conclusion of the trial, this petition is allowed and the petitioner is directed to be released on bail subject to his furnishing bail/surety bonds to the satisfaction of the trial Court/Illaqa Magistrate/Duty Magistrate. However, it will be open for the prosecution to apply for cancellation of bail of the petitioner, in case he is found involved in any other case or misusing the concession of bail, in any manner.
