******* ARVIND SINGH SANGWAN, J. (ORAL) Prayer in this petition is for grant of regular bail in FIR No.112 dated 01.12.2018 under Sections 420, 465, 468, 471, 120-B IPC, registered at Police Station Vairoke, District Fazilka.

Learned counsel for the petitioner submits that wife of the petitioner/co-accused Shaveta Sethi has already been granted the concession of regular bail vide order dated 09.02.2021 passed in CRM-M-2473-2021 and she has already deposited a sum of Rs.5.00 lacs in the shape of FDR with the Illaqa Magistrate. Learned counsel has referred to another order dated 01.02.2022 passed in CRM-M-51341-2021, vide which Coordinate Bench has granted the concession of regular bail to the petitioner in another FIR No.98 dated

CRM-M-52758-2021 -210.06.2019 under Sections 420, 465, 467, 468, 471, 120-B IPC, Police Station Guruharsahai, District Ferozepur. It is further submitted that the petitioner is in custody for the last 01 year, 02 months and 09 days; offences are triable by the Court of Magistrate and despite the fact that charges were framed on 20.01.2021, out of total 28 prosecution witnesses, none has been examined so far, therefore, it will take some time in conclusion of the trial. Learned State counsel, on the basis of custody certificate filed in the Court today, has not disputed the factual position. After hearing learned counsel for the parties, without commenting anything on merits of the case and considering the aforesaid facts and circumstances of the case and also considering long custody of the petitioner, this petition is allowed and the petitioner is directed to be released on regular bail subject to furnishing his bail/surety bonds to the satisfaction of the trial Court/Illaqa Magistrate/Duty Magistrate, concerned. Petition is disposed of.
