The present petition has been filed inter alia praying for issuance of a writ in the nature of mandamus seeking directions to respondents No. 2 to 4 to protect the life and liberty of the petitioners. 2.

At the outset, learned counsel for the petitioners submits that after filing of this petition, the matter has been resolved between the parties and prays for withdrawal of present petition. 3.

However, a perusal of the record demonstrates that the petitioners have tried their best to hoodwink this Court as they have concealed material facts from this Court. The petitioners had earlier approached this Court by filing CRWP-8649-2023 (Annexure P-4) which was dismissed on merits on 02.09.2023, as the petitioners had concealed the fact that the wife of petitioner No. 2 is none other than the elder sister of petitioner No. 1. The petitioners are in a prohibited relationship and have PARUL 2023.10.20 16:35 I attest to the accuracy and authenticity of this document

2023:PHHC:122029 CRWP-8832-2023 misused this Court and these proceedings to cover up the same. The petitioners have failed to demonstrate any threat perception except for making bald and vague allegations. There is no date, time or place mentioned when the petitioners were threatened by the private respondents nor there is any cogent proof with the petitioners that respondents have created any trouble or acted in a manner, which could demonstrate any iota of threat.

Despite the above, the petitioners have preferred this second petition for the same relief which is not permissible in law. The petitioners have tried to mislead this Court.

Therefore, I find it a fit case to impose a cost of Rs. 10,000/- on both the petitioners. The payment of cost of Rs. 10,000/- is to be deposited by the petitioners jointly within three months from today in the following account:

In case, the petitioners fail to deposit the cost, appropriate proceedings be initiated against them.
