Mr. Rajat Gautam, Additional Advocate General, Haryana. MANJARI NEHRU KAUL, J. (ORAL) Petitioner is seeking the concession of anticipatory bail in FIR No.144 dated 20.06.2024 under Sections 406, 420 and 120-B of the Indian Penal Code, 1860, registered at Police Station City Panipat. 2.
Vide order dated 02.09.2024, the petitioner had been granted interim anticipatory bail with direction to join investigation and the relevant part of the said order reads as under:- "Learned counsel, inter alia, contends that totally false allegations have been levelled against the petitioner of alluring the complainant into marrying of his son with one Jyoti. Learned counsel submits that it is highly improbable that on the alleged lure given, the complainant would have agreed to marry of his son with Jyoti without verifying her antecedents. It has been submitted that the petitioner is not involved in any other criminal case and even otherwise the lure was of only Rs.65,000/-."

Learned State counsel, on instructions, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioner is not required for further investigation much less for her custodial interrogation.

In view of the above, the petition is allowed and interim order dated 02.09.2024, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) BNSS.
