Status report by way of an affidavit dated 01.12.2023 of Dr. Jyoti Yadav, IPS Superintendent of Police, Headquarters, District SAS Nagar filed by learned State counsel is taken on record. Registry to scan the same and tag at the appropriate place.

Learned counsel for the complainant has pointed out that the facts as narrated in the order dated 06.09.2023 were not correctly given by the learned counsel for the petitioner. It is further contended that in the order dated 06.09.2023 it has been noticed that the marriage of the petitioner with the complainant was solemnized on 22.09.2012. Learned counsel has further pointed out that the said marriage was solemnized on 23.02.2019. 3.

Learned counsel for the petitioner states that the date of 22.09.2012 has inadvertently been noticed in the order dated 06.09.2023 and AMAN JAIN 2023.12.02 09:49 I attest to the accuracy and integrity of this judgment/order.

CRM-M-44765-2023 (O&M) -2that the date of marriage is actually 23.02.2019. 4.

Perusal of the paper book would reveal that in para No.2 it has been mentioned that the marriage of the complainant with the petitioner was solemnized on 22.09.2012.

Learned counsel for the petitioner states that the date was taken by the petitioner himself from the petition filed by the petitioner herein under Section 13(1)(iB) of the Hindu Marriage Act, 1955 and that there was no intention on his part to mislead the Court. 6.

At this stage, learned counsel for the petitioner seeks permission to withdraw the present petition. Permitted to do so. 7.

Dismissed as withdrawn. Pending applications, if any, also stand disposed off.
