Mr. Sukhmeet Singh, Advocate for the petitioner. **** HARNARESH SINGH GILL, J.(Oral) Challenge is to the order dated 19.04.2022 passed by the learned Additional Sessions Judge, Rupnagar, in case bearing FIR No.195 dated 02.11.2020, registered under Section 379-B IPC, Police Station Sadar Rupnagar, District Rupnagar, vide which the bail/surety bonds of the petitioner were cancelled and his non-bailable warrants of arrest were issued.
Learned counsel for the petitioner submits that the petitioner was granted the concession of bail by the learned Additional Sessions Judge, Rupnagar on 19.11.2020; that the petitioner was regularly appearing before the Court concerned but could not appear on 19.04.2022 and had moved an application seeking exemption from personal appearance; that the said application was dismissed and the bail/surety bonds of the petitioner were cancelled and non-bailable warrants of arrests were issued and that the non-appearance of the petitioner was not intentional but due to unavoidable circumstances. He further submits that the petitioner is ready to appear before the Court AMAN JAIN 2022.10.21 11:35 I attest to the accuracy and authenticity of this order/judgment

On the asking of this Court, Mr. Joginder Pal Ratra, Sr. DAG, Punjab, accepts notice on behalf of respondent No.1-State and submits that earlier also, the petitioner jumped the bail and accordingly, his bail/surety bonds were cancelled vide order dated 15.07.2021 passed by the Court below. He further submits that the petitioner approached this Court vide CRM-M-29586-2021 and vide order dated 29.07.2021, the said petition was disposed of with a direction to the petitioner to surrender before the trial Court and on his doing so, the trial Court was directed to release him on bail. Still further, it is submitted that the petitioner had been moving exemption applications one after the another and trying to delay the proceedings.
I have heard the learned counsel for the parties. As per the impugned order, the petitioner is in the habit of moving exemption applications on one pretext or the other. Moreover, the exemption applications moved by the petitioner were not supported by the affidavit(s) or any concert evidence, though, many times, the same were allowed by the trial Court. It appears that the petitioner is trying to hamper the Court proceedings.
In view of the above, no ground is made out to interfere with the well reasoned order passed by the Court below. Dismissed.
