Seeking issuance of directions to quash the impugned order dated 06.08.2024 passed by respondent No.1, vide which case of the petitioner for premature release has been rejected, petitioner has come up before this Court by filing the present petition under Article 226 of Constitution of India r/w 582 of BNSS 2023. 2.

Custody certificate of the petitioner has been handed over by the State, which is taken on record and as per which, petitioner has undergone 26 years & 29 days of custody in the FIR captioned above.

Given the custody spent by the petitioner, a fresh decision be taken by the authority concerned, in this regard on or before 25.10.2024 positively. It is clarified that such order must be a reasoned order, and the same be communicated to the petitioner as well as his counsel without delay and through e-mail, which the petitioner's counsel would give to the State counsel today itself.

Given above, petition is disposed of with the aforesaid observation. Liberty reserved to the petitioner to approach this Court again, if need arises. All pending applications, if any, stand disposed.
