under investigation. Accordingly, it is contended that the case of the petitioner is squarely covered by the judgment passed by a co-ordinate Bench of this Court in "Mohan Lal @ Mohna Vs. Union of India and others", 2023 SCC Online P&H 1391.

Learned State counsel, on instructions from M.H.C. Jaskaran Singh, Police Station Phase-11, Mohali, does not dispute the fact that the aforesaid case is still under investigation and that the challan has not yet been presented against the petitioner.

Learned counsel for respondents No.1 and 2 submits that since the challan has not yet been presented against the petitioner in FIR No.105 dated 12.08.2024, the case of the petitioner shall be considered by the competent authority in the light of the decision rendered in Mohan Lal @ Mohna's case (supra), and a final decision on the petitioner's application for issuance of a passport shall be taken within a period of eight weeks from today.

Keeping in view the aforesaid submissions made by learned counsel for the parties, the present writ petition is disposed of with a direction to the respondent/competent authority to consider and decide the application for issuance of passport submitted by the petitioner in the light of judgment rendered by a co-ordinate Bench of this Court in Mohan Lal @ Mohna's case (supra) within a period of eight weeks from today. 6.
