This petition has been filed for regular bail under Section 483 of BNSS in case FIR No.117 dated 30.05.2025 under Sections 22, 61, 85 of NDPS Act registered at Police Station Subhanpur, Kapurthala. 2.

Learned counsel for the petitioner submits that the case of the prosecution is that the petitioner has been allegedly found in possession of 630 intoxicating tablets. The petitioner is in custody since 30.05.2025. He submits that the FSL report is not filed.

Mr. Gautam Thapar, Sr. DAG, Punjab accepts notice on behalf of the respondent-State. Learned State counsel has filed the custody certificate in the Court today, which is taken on record. As per custody certificate dated 03.08.2025 the petitioner is in custody for 02 months and 03 days and he is involved in one more case under the NDPS Act, 1985, however, he is on bail in that case. He further submits that FSL report is still awaited and the case Sonia Puri 2025.08.05 19:05 I attest to the accuracy and integrity of this document

I have heard the learned counsel for the parties and perused the record.

In view of the statement of the learned State counsel, this petition is allowed. In the meanwhile, the petitioner is granted concession of interim bail on his furnishing requisite bail bonds, surety bonds to the satisfaction of the trial Court/Duty Magistrate/Chief Judicial Magistrate concerned till the filing of FSL report. The petitioner is directed to surrender before the trial Court concerned and seek regular bail, when the FSL report is received and supplementary challan is prepared. (H.S.GREWAL) 04.08.2025.
