The jurisdiction of this Court has been invoked under Section 482 Cr.PC praying for quashing of the orders dated 29.05.2024, 11.10.2024 and 21.01.2025 (Annexures P-3 to P-5) respectively passed by learned Addl. District and Sessions Judge, Ludhiana vide which the bail bonds of the petitioner were cancelled and non-bailable warrants were issued and later on, proclamation was issued against the petitioner in case FIR No.132 dated 18.07.2021 under Section 15/61/85 of NDPS Act registered at Police Station Sahenewal, District Ludhiana.

Learned counsel for the petitioner submits that after registration of FIR, the petitioner was regularly appearing before the Court below. Thereafter, due to his profession as truck driver, he could not appear before the Court below and later on, non-bailable warrants were issued against him. Learned counsel for the petitioner submits that the petitioner being a truck driver, was not aware about proclamation proceedings. It is submitted that the petitioner's non-appearance was neither intentional nor willful. He further SONIA BURA 2025.08.01 14:05 I attest to the accuracy and integrity of this document
CRM-M-40278-2025 undertakes on behalf of the petitioner that the petitioner will join the trial court proceedings within ten days.

Learned State counsel accepts notice on behalf of respondentState and not averse to the undertaking given on behalf of the petitioner. 5.
Without addressing the merits of the case or the legality of the orders, as the same have not been contested by the learned counsel for the petitioner, who has voluntarily agreed to join the proceedings before the trial court and to pay a penalty of Rs. 15,000/- to the Punjab & Haryana High Court Bar Association Lawyers' Family Welfare Fund for causing unwarranted delay in the trial proceedings, the orders dated 29.05.2024, 11.10.2024 and 21.01.2025 (Annexures P-3 to P-5) respectively are hereby set aside. However, the aforesaid orders would be subject to fulfillment of undertaking given before this Court on behalf of the petitioner that he will surrender within a period of 10 days. In case, if any application seeking regular bail is moved by the petitioner, the same be considered by the Court below preferably on that very day in accordance with law. The amount so deposited by the petitioner shall not be construed as cost for this order but penalty for stalling the court proceedings by evading himself from trial for a long time. 6.
