(ORAL) Through this petition, the petitioners seek anticipatory bail in case bearing FIR No.199 dated 28.10.2021, registered under Sections 353, 186, 355, 294, 506, 148, 149 and 120-B IPC, at Police Station City Sangrur, District Sangrur.

Vide order dated 07.12.2021 passed by a Coordinate Bench of this Court, the arrest of the petitioners had been stayed. Learned counsel for the petitioners submits that though the arrest of the petitioners was stayed, yet the fact remains that the petitioners have joined the investigation.

Learned State counsel, on instructions from Inspector Ramandeep Singh submits that the petitioners have joined the investigation and are now not required for any further investigation and that the challan has also been presented.

201-C CRM-M-51233-2021 (O&M) -2Keeping in view the fact that the petitioners have already joined the investigation and are no longer required by the investigating agency, the present petition is allowed and while treating the order dated 07.12.2021 staying the arrest of the petitioners, as the one granting anticipatory bail to the petitioners, the same is made absolute, subject to the conditions as envisaged in Section 438(2) of the Code of Criminal Procedure.

It is made clear that if pursuant to and in compliance with this order, the petitioners do not cooperate with the investigating agency the investigating agency would be at liberty to move an appropriate application for the cancellation of bail.
