(Oral) In the present protection petition, after hearing the submission on 17.10.2022, this Court has passed the following order: "Present: Mr. Beer Singh, Advocate for the petitioners. -.- Prayer in the instant petition filed under Article 226 of the Constitution of India, is for issuance of directions to respondents No.2 & 3, to provide protection of life and liberty to the petitioners, who have married against the wishes of private respondents.

Learned counsel for the petitioners submits that Petitioners have got performed marriage on 10.10.2022, against the wishes of their family members, arrayed as respondents No.4 & 5. It has been further submitted that the private respondents are threatening to interfere in the marital life of the petitioners. Hence, they are seeking protection in that regard and have approached this Court by way of filing the instant petition.

Notice of motion.

On asking of the Court, Mr. Vikas Bhardwaj, AAG, Haryana, accepts notice on behalf of respondents No.1 to 3 (State).

At this stage, Mr. Ravi Rana, Advocate, has put in appearance on behalf of respondents No.4 & 5, who are parents of petitioner No.1. Vakalatnama filed on behalf of respondents No.4 & 5 in Court is taken on record, subject to all just exceptions.

Let requisite copies of the complete paper book be supplied to learned State counsel as well as learned counsel for respondent No.4 & 5 during course of the day. Learned counsel for respondents No.4 & 5 submits that as per his knowledge, official respondents have already acted upon representation dated 10.10.2022 (Annexure P-4), and RIYA 2023.05.25 18:09 I attest to the accuracy and integrity of this document

Learned State counsel, on instructions from SI Harbans Lal, submits that as per the statements of respondents No.4 & 5, they have no objection to the marriage of the petitioners. Learned State counsel as well as learned counsel for respondents No.4 & 5 seek time to file their respective replies in the matter.

May do so, on or before the next date of hearing. Adjourned to 28.10.2022.

However, meanwhile, looking at the apprehension qua life and liberty of the petitioners, respondent No.2, would examine the situation as projected by the parties and thereafter, if really so required, in accordance with law, necessary steps for protecting the life and liberty would be taken. " Perusal of the file reveals that on 09.11.2022, also there was no representation on behalf of the petitioners.

Today, learned State counsel while referring to the reply dated 17.12.2022 filed on behalf of respondents No. 1 to 3, which is available on record, submits that both the petitioners have got recorded their statements to the police that they do not require any kind of protection as of now. In their statements, respondents No. 4 and 5 have also stated and ensured that they will not interfere in the marital life of the petitioners, and will not cause any harm to the petitioners in any manner. Thus, learned State counsel submits that no cause of action survives in the present petition and same may be disposed of.

I have gone through the pleadings of the present petition and aforesaid reply filed by the State. The apprehension of the petitioners has been cooled down on account of taking appropriate measures by the respondents-State in compliance of the order dated 17.10.2022 passed by this Court. No cause of action survives with the petitioners. Moreover, there is no representation on behalf of the petitioners, which itself shows that they are no longer interested in pursuing the present petition. 5.
