In consonance with the order dated 09.12.2025, a cheque bearing No.055434 dated 11.12.2025, for the amount of Rs.2,82,000/- has been handed over by counsel for the petitioner to the counsel for the respondent, copy whereof is retained on the record. The same is in consonance with the calculation of the outstanding amount, as furnished by counsel for the respondent today in the Court. In view of the handing over of the cheque to the counsel for the respondent, an undertaking has been given by counsel for the petitioner, at the behest of the petitioner that the said cheque shall be encashed, in due course and in the eventuality of not being done so, for any reason, the VINEET GULATI 2025.12.15 09:27 I attest to the accuracy and authenticity of this document Chandigarh

CR-4778-2025 -2petitioner shall be liable for any action to be taken against him, in accordance with law, whether filing of a complaint under Section 138 of the Negotiable Instruments Act or contempt proceedings. In the light of receipt of the cheque, counsel for the respondent has made a statement that the execution bearing No.55 of 2023, filed at the instance of the respondent, for seeking execution of the money decree passed in Civil Suit No.112 of 2018, decided on 30.01.2023, copy whereof is Annexure P-2, shall be withdrawn by the respondent, on the next date of hearing before the Executing Court i.e. 18.12.2025. In view of the statement got recorded by counsel for the respondent, it has been submitted by counsel for the petitioner that he does not want to pursue with the present revision petition, which may be dismissed as withdrawn, being compromised.

Ordered accordingly.

However, it is made clear that the parties shall remain bound by the statements made by their respective counsel.
