The petitioner has approached this Court seeking grant of regular bail in a case registered vide FIR No.247 dated 17.8.2021 at Police Station Bilaspur, District Yamuna Nagar under Sections 307, 34 IPC and Sections 25, 54, 59 of the Arms Act, 1959. 2.

Learned counsel for the petitioner submits that it is a case of crossversion and that the matter has been amicably resolved amongst the parties. It has been submitted that co-accused Sohard @ Munna has already been granted regular bail by this Court vide order dated MOHAN SINGH 2021.12.15 17:28 I attest to the accuracy and integrity of this document

CRM-M-51414-2021 (O&M) - 2 - 29.11.2021 keeping in view the amicable settlement amongst the parties (Annexure P-3). It has also been informed that the complainant has turned hostile while recording his statement before the trial Court.

On the other hand, while opposing the petition, learned State counsel has pointed out that there is one more case pending against the petitioner.

In view of the aforestated position, wherein the matter is stated to have been compromised as is specifically evident from order dated 29.11.2021 passed in the case of co-accused wherein the complainant had admitted the factum of compromise and while also noticing that the complainant turned hostile, the petition merits acceptance. The petition, as such, is accepted and the petitioner is ordered to be released on regular bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
