-.- JAISHREE THAKUR J. (ORAL) This is a petition that has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in FIR No.34 dated 16.03.2021 registered under Sections 379-B, 34 IPC (Section 411 IPC added later on) at Police Station Verka, District Amritsar.

Learned counsel appearing for the petitioner would contend that the petitioner has been falsely implicated in the aforesaid matter, as there is an inordinate delay of two days in registration of the FIR. The investigation has been completed and the challan stands presented. No other case is pending against the petitioner. The trial is likely to take some time to conclude, therefore, prays of concession of bail to the petitioner. Learned counsel appearing on behalf of the respondent-State opposes grant of regular bail to the petitioner, however, he does not dispute the fact that the investigation has been completed and the challan stands presented.

CRM-M No.53016 of 2021 (O&M) -2the paper book and keeping in view the fact that the investigation has been completed and the challan stands presented and the fact that the trial is likely to take some time to conclude, no useful purpose would be served in keeping the petitioner behind bars. The instant petition is allowed and the petitioner is directed to be released on regular bail on his execution of adequate personal/surety bonds to the satisfaction of concerned trial court/Duty Magistrate. However, any observation made herein shall not be construed to be an expression on merits of the case.
