Mr. Rao Ajender Singh, Advocate for the respondent. RAJESH BINDAL, J Learned counsel for the respondent submitted that now he has no instructions to appear on behalf of the respondent, as all his effort to contact him remained futile.
Prayer in the present petition is for transfer of the divorce petition filed by the respondent-husband from Rewari to Panchkula, as the applicant-wife is living with her parents at Pinjore. Two other cases filed by the applicant that is one under the Protection of Women from Domestic Violence Act, 2005 (for short "the Act") and another petition filed by the wife claiming maintenance under 125 Cr.P.C. are pending at Kalka, in which despite service, respondent is not being appearing. In complaint under the Act, bailable warrants have been issued for service of the respondent.
Considering the aforesaid factual matrix, in my opinion, the divorce petition filed by the husband deserves to be transferred to Panchkula from Rewari.
The parties are directed to appear before the District Judge, Panchkula on 29.4.2015 for further proceedings. The District Judge, Panchkula may either to keep the case with him or entrust the same to some other competent court.
The petition stands disposed of.
