***** KARAMJIT SINGH , J. (Oral) The petitioner has filed this petition seeking regular bail in case bearing FIR No.217 dated 19.10.2021 registered under Sections 420, 465, 468, 471, 120-B IPC at Police Station Mataur, District SAS Nagar. Notice of motion.

On the asking of the Court, Mr. A.S. Dhaliwal, DAG, accepts notice on behalf of State of Punjab and filed custody certificate of the petitioner which is taken on record.

( 2 ) CRM-M-52856-2021 The counsel for the petitioner contends that the petitioner has been falsely implicated in the present case and he is in custody since last two months and is having no criminal history.

The bail application is opposed by the State counsel, who submitted that the petitioner has been named in the FIR and prayed for dismissal of the instant petition.

I have considered submissions made by the counsel for the parties.

As per the allegations appearing in the FIR, the petitioner and one another person Nand Kishore produced false and fabricated documents including identity proofs for purchase of mobile phone after availing loan. The petitioner was apprehended at the spot on 19.10.2021. Since then he is in custody. The offence is triable by Judicial Magistrate Ist Class and it will take time for conclusion of trial as challan is yet to be presented. So, no purpose will be served by keeping the petitioner in custody for any longer period. Thus without commenting on the merits of the case, the petition is hereby accepted and the petitioner is ordered to be released on regular bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Duty Magistrate concerned.
