The defendant No.1 has filed the present revision petition challenging the correctness of the order dated 05.08.2019 dismissing the application under Order VI Rule 17 CPC for permission to amend the written statement and to file counter claim in a suit for recovery of ₹26,36,324.99. On bare reading of the order passed by the learned Court below, it is apparent that the application was filed at a belated stage and the Court found that the counter claim has become time barred.
