RAMENDRA JAIN, J. (ORAL) Through this petition under Section 438 Cr.P.C., petitionerRaj Kumar, has prayed for grant of anticipatory bail in case FIR No. 326 dated 13.08.2017 registered under Section 409 IPC at Police Station Kanina, District Mahendergarh.

According to prosecution, the petitioner, during his tenure as Sarpanch of Gram Panchayat, Sayana, misappropriated/usurp Government fund by executing sub-standard development work in his area and caused loss to the State exchequer to the tune of ` 20,41,000/-. On instructions from ASI Vijay Pal, learned State counsel submits that though, the petitioner has joined investigation, but recovery of aforesaid mis-appropriated amount of the Government fund could not be effected from him. Therefore, he does not deserve the concession of anticipatory bail.
