***** HARKESH MANUJA J. (Oral) Present petition is directed against the eviction order dated 13.02.2017 passed by Rent Controller, Panipat and affirmed by learned Appellate Authority, Panipat vide order dated 02.09.2022. 2.

After arguing for sometime, counsel for the petitioner stated that she does not press the petition on merit but the petitioner may be given reasonable time to make arrangement of alternative accommodation for his business.

In view of the above, eviction order dated 13.02.2017 passed by the Rent Controller, Panipat and affirmed in appeal by the Appellate Authority, Panipat is confirmed, however, subject to following conditions:- i) the petitioner shall hand over vacant possession of the tenanted premises to the respondents/landlord on or before 13.10.2023; ii) the petitioner shall furnish an undertaking before the Rent Controller, Panipat within fifteen days from today that he will hand over vacant possession of the tenanted premises to the respondents on or before SONIKA 2022.10.19 11:10 I attest to the accuracy and integrity of this document

CR-4383-2022 --2-- 13.10.2023; and iii) the petitioner shall clear arrears of rent, if any, as per the findings recorded by the authorities below, within a period of one month from today and will continue to clear the arrears by seventh of each month, till 13.10.2023.

Failure of the petitioner to comply with either of the conditions would entitle the respondents/landlord to execute the eviction order forthwith.

Keeping in view the nature of proceedings, the present petition is being disposed off without issuing notice to the respondent, least it may further delay the proceedings.
