The petitioner is a tenant, who has been ordered to be evicted by the Rent Controller on two different occasions. He was initially ordered to be evicted vide an order dated 13.11.2018 when he failed to deposit the provisional rent, assessed by the Rent Controller. Subsequently, also he did not deposit the rent and therefore, he was again ordered to be evicted on 14.03.2019.

Against the first order dated 13.11.2018, the petitioner filed an appeal wherein the interim protection was granted, subject to the deposit of the amount of arrears of rent vide an order dated 03.01.2019. The petitioner, still, did not deposit the amount, within the time prescribed. Thereafter, he withdrew the first appeal, filed before the Appellate Authority and challenged the order dated 14.03.2019 in a subsequently filed appeal along DEEPAK KUMAR BHARDWAJ 2021.12.16 11:26 I attest to the accuracy and integrity of this document with an application for condonation of delay of 371 days.

Keeping in view the conduct of the petitioner, the Appellate Authority has refused to condone the delay.

Heard the learned counsel representing the parties at length and with their able assistance, perused the paper book. 5.
The learned counsel representing the petitioner does not dispute that the petitioner has failed to deposit the rent on more than one occasion. 6.
Keeping in view the aforesaid facts, no ground is made out to interfere. Consequently, the present revision petition is dismissed. (Anil Kshetarpal) Judge December 13, 2021 "DK"
