NIDHI GUPTA, J. (ORAL) Prayer in this first petition filed under Section 439 Cr.P.C. is for grant of regular bail to the petitioner in case FIR No. 458 dated 01.07.2022 (Annexure P-1) registered under Section 365 IPC (Sections 328, 370-A, 376(2)(n), 376DA, 506, 509/34 and 120-B IPC and Sections 6, 10 and 17 of the Protection of Children from Sexual Offences Act, 2012 at Police Station Rohtak City, District Rohtak. Learned counsel for the State has filed custody certificate dated 07.10.2023, which is taken on record, as per which the petitioner has been in custody as an undertrial for a period of 01 year and 03 months.

After arguing for some time when this Court is not inclined to accord the benefit of regular bail to the petitioner, learned counsel for the petitioner submits that he may be permitted to withdraw the present petition, at this stage.

Permitted to do so.

Dismissed as withdrawn, at this stage.
