Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner, namely Surjit Singh in case FIR No. 66 dated 17.05.2019, registered under Section(s) 379 IPC at Police Station Bullowal, Hoshiarpur.
Learned counsel for the petitioner contended that the matter has been amicably settled between the parties, however, earlier petition under Section 438 Cr.P.C., filed by the petitioner for granting him pre-arrest bail, was dismissed by this Court vide order dated 19.07.2019 by observing as under:- "As per the prosecution case, the case relates to theft of 360 bags of wheat, which were to be distributed among the card holders as the same was FCI. Out of 360 bags, 20 bags were recovered from the house of co-accused Davinder Singh and 340 bags are yet to be recovered and for that purpose, DEEPAK KUMAR BHARDWAJ 2019.09.24 16:06 I attest to the accuracy and integrity of this document
Criminal Misc. No. M-40636 of 2019 investigation of the petitioner is necessary. The matter requires for intensive investigation. No case is made out to grant the concession of pre-arrest bail. As such, present petition stands dismissed."
As such, present petition is not maintainable and the same stands dismissed.
