RAJESH BHARDWAJ, J.(ORAL) Instant writ petition has been filed under Articles 226/227 of the Constitution of India praying for issuance of writ in the nature of mandamus directing the respondents to remove the encroachments done by residents of the village over water channel situated at Khasra No.323(2-6) Bigha at village Andheri, Tehsil and District Sangrur, as the said water channel is being used to cultivate the agriculture land of the petitioner. It is further prayed to issue directions to the respondents to conduct proper demarcation of the place at Khasra No.323(2-6) where the above-mentioned water channel is situated. It is also prayed to restrain the respondents from constructing water channel at any other place to accommodate the encroachers.

It has been contended by counsel for the petitioner that representation, Annexure P-4 , was filed by he petitioner before respondent No.4 on 20.07.2023 but no decision has been taken on the same till date. MEENU 2023.09.13 17:18 I attest to the accuracy and integrity of this order/judgment

After hearing counsel for the parties and going through the facts and circumstances of the case, the present petition is disposed of with a direction to respondent No.4, i.e. Sub Divisional Magistrate, Sangrur, to decide the representation, dated 20.07.2023, Annexure P-4, expeditiously in accordance with law preferably within one month from the date of receipt of certified copy of this order.
